Tenant Nonpayment: What DC Metro Landlords Need to Know and Do

  • Washington, DC: 30-Day Notice to Quit (for nonpayment). DC's notice period is significantly longer than other jurisdictions. Errors in notice drafting or service can void subsequent eviction proceedings.
  • Virginia: 5-Day Pay or Quit Notice (VRLTA). After 5 days without payment, you may file for possession in General District Court.
  • Maryland: In most cases, landlords can file for eviction in District Court immediately after a missed rent payment without a prior formal notice period.

Step 4: File in Court if Payment Is Not Received

If the notice period expires without full payment, file an eviction action in the appropriate court:

  • DC: DC Superior Court Landlord-Tenant Branch
  • Virginia: Virginia General District Court (Arlington, Alexandria, or Fairfax)
  • Maryland: Maryland District Court (Montgomery or Prince George's County)

Step 5: Attend the Hearing and Obtain Judgment

  • Require online rent payment through a tenant portal — electronic payment reduces missed payments due to check loss or banking delays
